The Collaborative Divorce Process
The essence of Collaborative Divorce is to provide a new way for a divorcing
couple to work as a team, together with trained professionals who help both
parties resolve divorce issues in a respectful manner, without going to court.
It provides an opportunity for the couple to have a significant level of control
over the outcome of the process, very much unlike traditional court-based
divorce. Each client has the support, protection and guidance of his or her
own lawyer. In addition, other professionals such as a financial advisor and
child specialist are brought in, if necessary, to help resolve specific disputes.
One of the core elements of this process is the parties' contractual
commitment not to threaten litigation at the drop of a hat, or run off to court
to resolve divorce disputes. Instead, the parties agree to negotiate a
mutually acceptable settlement with respect to the various issues which must
be resolved during a divorce, such as child custody & visitation, child support,
fair and equitable distribution of property as well as spousal maintenance.
